Big Brother’s Mike Malin guilty of stalking co-star Dr. Will Kirby, sentenced to two-year probation

Big Brother star Mike ‘Boogie’ Malin has been found guilty of stalking fellow season 2 castmate Dr. Will Kirby and has been sentenced to two-year probation.

The 50-year-old reality star – who went on to win in season 7 – was found guilty of felony stalking following his August 2019 arrest according to court documents obtained by Us Weekly. 

Malin had initially pleaded not guilty after being arrested and charged with stalking the 48-year-old aesthetic dermatologist and winning of Big Brother season 2.

The weekly reports that the court documents state that Malin had withdrawn his original plea and changed it to ‘nolo contendere,’ AKA no contest, which waives his right to a trial by changing his plea.

The bar owner appeared in court in April where he was sentenced to a two-year probation and will be required to spend three days in a Los Angeles County jail.

In addition Malin must pay $70 in fees and serve 30 days in a residential treatment program which has been selected for him.

The former reality star has also been ordered to pay $300 restitution to court, ‘effective upon the revocation of probation’ and cooperate with his probation officer for ‘mandatory supervision’ according to Us Weekly.

On top of that, Malin must also ‘make restitution’ to the victim Dr. Will ‘in an amount to be determined at a hearing.’

The reality star was also ordered to ‘maintain residence as approved by the probation officer’ and ‘keep [the] probation officer advised of [his] residence and work and home telephone numbers at all times.’

The weekly also reports that Malin must also complete 160 hours of community service per the plea agreement in addition to submitting DNA for a database.

The documents obtained by UsWeekly also state that Malin was ‘instructed by the court’ to be ‘prohibited from owning, purchasing, receiving, possessing or having, under his/her custody or control, any firearms, ammunition and ammunition feeding devices.’

He was also ‘ordered to relinquish all firearms’ if any were already in his position.

Back in September 2019, Dr. Will was granted a restraining order against Malin.

He was then granted an additional 10-year restraining order preventing Malin from coming near him, his family, or any of the 66 LaserAway clinics he owns.

The two have a two-decade history together as they starred on the second season of Big Brother together in 2001 and even had an alliance called Chilltown with fellow housemate Krista Stegall which helped Dr. Will win the season.

This is not Malin’s only recent run-in with the law as Us Weekly reported in November that he was arrested for driving under the influence in Las Vegas in August 2020.

 According to the arrest report from the publication, Malin was pulled over after law enforcement was alerted that a swerving vehicle had hit a curb and nearly hit their car.

The restaurateur failed a sobriety test administered by police at the scene and was charged with possession of a drug without a prescription, having an open alcohol container and unlawfully texting before being released on his own recognizance according to the report.

Back in 2011, Malin was sued for embezzlement and later ordered to pay $800,000.
